Failure to respond within ten days from receipt of this request will be considered agreement by the accusers that this disciplinary action will be excluded from Child's Name' official school records and will not be used as the first in a chain of "more severe disciplinary actions". The stated "REASON FOR REFERRAL" of "disruptive behavior during heath screenings" is overly broad, vague and grounds for dismissal of the accusation. The 'Disciplinary Referral Form' has been incorrectly filled out. In the space to 'DESCRIBE BEHAVIOR OF STUDENT (SPECIFICALLY): (Attach Additional Sheets If Necessary)' it was instead written: "Continued disruptions will result in more severe disciplinary actions." For this reason alone this accusation should be dismissed. Questions for the Accusers: One. Are there accusers in addition to the ones named above? Two. What are the names of all of the accusers? Three. Who exactly are the witnesses to the accusation? Four. Did each witness and accuser complete a detailed written, dated, and signed complaint by the witness' own hand DESCRIBING THE EXACT SPECIFIC BEHAVIOR complained of in detail? If so please provide copies with the answers to these questions. If not please obtain detailed written and signed complaints from each witness and accuser and provide copies with the answers to these questions. Five. If each witness and accuser did not complete a detailed written, dated, and signed complaint what was the accusation based on? Six. Is it true that the accusation was based on getting other students to "give names", instead of being "disruptive behavior" witnessed by the accusers? Seven. What is the exact nature and cause of the accusation? Eight. Who, by name, is the ‘person' which is purportedly to have been ‘Damaged' and upon which the accusation is based? Nine. The time of the incident is not on the 'Disciplinary Referral Form'. What was the exact time of the alleged incident. Ten. What is the exact location of the alleged incident, in which classroom, or which hallway, etc.? Eleven. How many other students, teachers, bystanders and witnesses were present at the time of the alleged incident? Twelve. What are each of the names of the other students, teachers, bystanders and witnesses? Thirteen. What appeal process is afforded the accused prior to the scheduled punishment of "SATURDAY SCHOOL"? Why are the parents not notified of the appeal process? Fourteen. Why when a parent shows up with the accused at "SATURDAY SCHOOL" to object and request that the punishment be delayed a week until they have had an opportunity to discuss the accusation with the principal they are told that if the accused does not attend as scheduled he would be treated as a no show and subject to more severe punishment? Fifteen. Twenty-four hours notice is insufficient for a parent to discuss the accusation with the accusers prior to the scheduled punishment. Why are parents not notified at least a week in advance? Sixteen. Is there a governmental agency other than the school system involved in any way with the Disciplinary Referral Form process? Seventeen. Is the Accuser's purported charge a criminal case, i.e., is there any possibility of incarceration, imprisonment, or a criminal fine, and if so, which?
