Bouvier's Law Dictionary Is this the ranting of some half-crazed radical that does not know crap from shinola? First, let us examine Bouvier's interpretation. The very first ruling set the record straight. This opinion was uttered back when the one supreme Court - a true constitutional Article III court of law taken as the Natural and Common Law that governs the people - was the only supreme Court. At this time, the United States Supreme Court, a municipal court for the District of Columbia, territories, and other bona fide jurisdictional areas of the United States, did not exist. "No such ideas (government as the sovereign) obtain here: at the revolution, the sovereignty devolved on the people; and they are truly the sovereigns of the country, but they are sovereigns without subjects (unless the African [472] slaves among us may be so called) and have none to govern but themselves; the citizens of America are equal as fellow citizens, and as joint tenants in the sovereignty." Ed. 440 (1793) This opinion of the sovereignty of the people declared by "The unanimous Declaration of Independence of the thirteen united States of America" has never been overturned, and as long as America created by the Declaration and then the government-limiting Constitution for the united States of America exist, then no government or government entity has any authority over the people. Sovereign means "supreme", not if the government allows it. For what is government, other than a tool dreamt up by the people, a fiction at law that must, if not traitorous to the united States of America, obey the rule of law laid down by our Creator, and the two above documents? It is only a force to be dealt with when it acts outside its limitations. It becomes a deadly force then, with only tyranny over the people becoming its agenda. And, for what one might ask. Why do elected officials, and the corrupt corporations controlling them want plenary, tyrannical control over human beings? Some people will say "yeah, but we have to have rules to live by". We do. We have God's laws and the fact that all men are free to act as they will, so long as they do not interfere with another's rights. Neither government nor any elected official in his official capacity has any rights to violate. They are in their official capacities complete fictions under the control of the people. That is not to say the majority of the people, for the majority means nothing in terms of human freedom. Majority applies only to democracies, which America is not, as it is nearly the antithesis of being free. In a democracy, the majority (always ends up being a extremely small minority) can vote away the rights of the minority. This is not the case in America, as every man and woman has equal rights with all others, rights that cannot be legislated or voted away. "The people are the fountain of Sovereignty. The whole was originally with them as their own. They both describe the political body who, according to our republican institutions, form the sovereignty, and who hold the power and conduct the government through their representatives. They are what we familiarly call the "sovereign people," and every citizen is one of this people, and a constituent member of this sovereignty. [Dred Scott v. Sandford, 19 How. 393 (1856)] Then, there is Hale v Henkel, which has been used in over 350 federal cases, and a multitude of other cases, reported to be over 1600 cases. This is the most oft cited paragraph. " He [the citizen] owes no duty to the State or to his neighbors to divulge his business, or to open his doors to an investigation, so far as it may tend to incriminate him. He owes no duty to the State, since he receives nothing therefrom, beyond the protection of his life and property. Ct. 492, 496m 505D (1993). This case is a wealth of information about the 4th and 5th Amendments, and due process, especially concerning private property, privacy, and rights. I could go on and on listing cases, as every case above cites other cases that have come to the same opinion, that government does not regulate people - it regulates artificial entities of its own creation and civil servants created by the people. It does not rule over the people, nor have any authority to regulate the exercising of rights by we Americans. Nor is there any such thing as immunity for officials that violate Article VI of the Constitution for the united States of America. It is a myth; it is false; it is a lie made up by attorneys and the like to protect the corrupt in government. So what happened? Well, between Americans being dummied down to near nincompoops by government controlled public schools, and the force used by law enforcers with allegiance not to the people, and the corruptness of "courts" that are not Article III courts of law, the people have been fooled and/or forced into servitude to government by those writing, passing, and enforcing rules and regulations upon the people that do not apply to the people. Fraud, extortion, physical abuse (including that no good shocking now being used by traitors wearing badges) and torture, stealing of private property (lacking in due process), obstruction of (true) justice, have become the name of the game for public/civil servants, guided by attorneys that seldom have any concept, if any, of what freedom entails, or the meanings of Natural and Common Law. The fraud began under Lincoln, as a good starting point, as he was for sure one of the most well-known corporate lackeys, that led this union into one of the bloodiest wars ever for the American people, a war solely to preserve corporate dollars coming in to the United States Government through tariffs. The big lie began; that we are one nation under God, and indivisible, when the truth is we are many nations (states) united in common cause for defense and the preservation of rights of the people. Others may be able to prove it started earlier, which is not a big issue with me. The issue with me is that government - including your damnable local governments - has usurped the power of the people by using armed and deadly force, along with false and extremely corrupt courts against the American people. It is terrorism of the highest order, and high treason. Few officials know it, as they are for the most part rather stupid. If they know it, then they are willing racketeers with the intent to commit treason and terrorism. Few people know it, and the few that do are ostracized as un-American, or some other false grouping meant only to misinform and mislead our people that do not pour over the actual provisions of our most important documents. They - the people - do not know the meaning of liberty and freedom, the role of public/civil servants of government or that government is authorized to govern only civil servants and other creations. The most of the people do not know nor read their state's constitution, and federal, state, and local rules along with to who or what they apply. They have placed their trust in elected public or appointed civil servants, a trust that has been violated 100 percent by every official from the smallest town's council up to the gargantuan federal government filled with leeches, liars, and felons. Can it be turned around? Sure, it can. But, it means that the people have to exercise their rights, and quit believing that government has the authority to govern the people. As was once said by a former dip in the White House (to drug use, your right if you so desire), JUST SAY NO to every edict affecting you, your property, your rights, and your status as an American Citizen and human being. Very easy but, if you go it alone expect to be ostracized or worse, as the lowest of officials - even secretaries in the offices of public/civil servants - do not like to be told they are wrong and treasonous bastards/bitches at best. We are at a crossroads with our enemy. "Our enemy" must be defined and treated as such. It is within, storming already the few remaining trenches of freedom. Who or what is the enemy? It is our elected/appointed officials, not the people or leadership of other countries, or our neighbors down the street fighting for human rights. For you cops and others - you are traitors hiding behind "doing your job", when your job is to protect the people not only from others who would infringe upon their rights, but the very anti-liberty organization you belong to. (Albert Einstein) Well, Tuesday, November 2, 2004, was the day that even the dumb, dumber, and dumbest could pretend to be great patriots and go cast their votes for officials or wannabe officials that most voters know little or nothing about. Becoming knowledgeable is just too darn much work. Besides, it might interfere with learning all those players on every sports team, or whatever else grasps the minds of the people during their leisure time. I have had several people tell me they voted for X just because they did not like Y, but felt if they voted for a candidate from some other party, they would waste their vote. I have been hearing that all my life. If every man or woman that has told me that had worked to remove the control of the Republi-Demo-Kraut coalition from elections and – hence – government, we now could conceivably not be subjected to massive voter fraud, attorneys in control of government and injustice, and might not have become known as the number one enemy of peace and freedom on Earth. We would conceivably not have our own people beaten and killed by law enforcers, while their bosses and the system of injustice we have allowed to develop does nothing in the way of redress to victims’ or to the victims’ families. Most people do not know of the huge numbers of beaten up, unlawfully arrested and convicted, and government sponsored (or at least tolerated) murdered people that occurs each year across this land of alleged “free” people. Think roughly 70 percent of those incarcerated each year, and I suspect most people killed during arrests and in home invasions by enforcers. We are not talking about just a few – we are talking about thousands resulting in billions of dollars unlawfully and illegally taken from people and their families, and billions more in private property taken by corrupt law enforcers, judges, and attorneys that have as a priority their own coffers and making sure they meet the needs of the STATE, rather than their duty to the American people. Yes, you corrupt minions holding government positions, your duty is to the people, not the STATE. You take an oath or are supposed to, before you may lawfully enter the office and take over serving the people. You are just disgusting cads when you do not serve the people with morality and integrity, and such failure to do so should result in your being tried and hung for treason. You are vile stinking traitors to America, whether you are called a cop, judge, attorney, or by the title of some other official. One might add that those people who blindly and dumbly support officials’ under color of authority actions for the good of the people, are also traitors to the real America. Our people that support the officials violating every principle this union was founded on have no comprehension of liberty or of the freedom they purport to relish. To understand fully the 4th, 5th, 6th, 7th, 8th, 9th, and 10th Articles of Amendment to the Constitution for the united States of America, one might study for hours and hours the case of U.S. v James Daniel Good Real Property, 114 S. Ct. 492, 496m 505D (1993). The reader might note that it is an opinion made in 1993, essentially 217 years after the sovereignty of the people in this union was laid down by "The unanimous Declaration of Independence of the thirteen united States of America, and 200 years after being opined in Chisholm, infra. (means above) At any rate, laws made by men apply only to artificial men (persons) made by men. This means that bodies politic made by men – government – may only regulate artificial entities, that have quite mistakenly been given the status of “persons” in order that they may be sued, sue, and so forth. Well, corporations and the like are not human beings, even though human beings make up such associations given privileges – not rights – by those we elect to serve our needs. To summarize, free men and women are not under the control of government entities we create. The exercise of rights cannot be limited by government rules but only by Natural Law or the Laws of God. Like it or not, that was the basis for the founding of our union of states – our society. We have just suffered another election, with hundreds spouting out the garbage that we are a “democracy”. WE ARE NOT A DEMOCRACY, as a democracy ignores the rights of the individual man or woman. Men cannot be free in a democracy, as his rights are always subject to the whims of the majority, or what is purported to be the majority. Usually, this amounts to less than half since usually no more that half vote, and finally boils down to just elected officials acting as if they are the majority via "polls" and the like. But, the fact is that even if every man, woman, and child voted to limit the exercising of any right from just one lone human being, it would be against our founding principles. That is the self-governing of each on his own guaranteed through a Republic form of government. Plus, one must think – if the rights of one can be voted or legislated away, the all rights of the whole of the people can be voted or legislated away, leaving us not as the land of the free, but the land of subjects of a new and quite tyrannical god – the STATE. Anyway, this last election has been touted as being the most important election in history. The fact is it was not the most important, and must not be treated as such. Every election is of equal value, or would be with an informed public. When those voting are uninformed, or misinformed, then the election is just a show with little or no value. The presidential election of 2004 was just a show, controlled by behind the scenes control of information made available to the people doing the voting. How many people, for example, know anything at all about the other numerous candidates? How many were informed properly that Congress and creations of Congress cannot change the election process detailed in the Constitution for the united States of America (original title and capitalization)? Were the votes electronically controlled to favor one or another? Without a paper trail, this is impossible to determine. To add to it, many people vote for a candidate dependent solely on what party they consider themselves to be part of. They will vote what is called a “straight ticket”, and never have to learn anything about anything. Or they will vote based on some imagined and/or preconceived notion that just because they believe something, and since they think of themselves as a member of a specific party, that those politicians holding office or wanting to hold office that say they are of the same party, also think the same way. Never mind that the history of the two major parties is the same – the control of rights of the people, devolving them into “privileges” under STATE control. When just one right becomes controlled, People, you are made a “SUBJECT” of the STATE – you are no longer a “FREE” human beings. However, most Americans do not know any of the above, nor do they want to know, as it might bring forth a sense of responsibility to help cause change from what it is to what it is supposed to be. They fear to learn, and to apply what they learn. They relish in believing they are “patriots” and “Americans” because they went to the trouble to get permission from the STATE to vote (since when does one need permission to vote in a free society), and then to go to a poll to vote. Should one at the most just have to show proof of birth within one of the many states? Is that not what makes us Americans – that is, united states' Citizens – and nothing else, including party affiliation? Now, they – those that voted – will talk about it for a while, and stroke each other for voting, while voting without considering the totality of the effects not only in the present, but also in the future. We have just been through four of the worst years ever in my lifetime of 59 years, and we are in for many more years. We had the most lying corrupt administration ever during the past four years, an administration that did more damage to world peace and the freedom of man than been realized to date, with repercussions that will last for generations. Now we face four more years of the same administration since it apparently has had its unlawful and illegal actions supported by people who for the most part have no idea of what is really going on - - - and may never know what they have helped spawn. Thus, watch as thousands more of unlawful actions are taken against our people contrary to the principles that once made our union – not NATION – the envy of the world’s people. Watch also as unlawful actions are taken against the people of the world, with no consideration that other countries are sovereign and not supposed to be under US dominion. But, those that help keep certain parties in power are "great" Americans and for a day or two will relish in their actions as such – they voted.
