A legal research team has uncovered evidence that the State Constitution published in the State's Publication Revised Code of Washington may be the wrong constitution! Researchers found a different constitution in the State Archives, which according to the State Archivist was voted on and accepted by the people of Washington Territory on November 5th, 1878, and which was subsequently submitted to congress as the constitution of the Washington republic as it applied to Congress for membership in the union. A review of the Congressional Record confirmed that this "other constitution" is in fact the one submitted to Congress for membership in the union. This "other constitution" was published by the Senate of the United States of America as the constitution of the Washington republic that applied for membership in the union, and was subsequently admitted as the 42nd member of the United States of America through the Enabling Act upon execution of the directions of the act by President Harrison. If this "other constitution" is determined to be the actual constitution for Washington, the state will have a significant dilemma in how to bring the current administration of the state into compliance with the "new" constitution. Among the issues to be resolved are that the general jurisdiction "Superior Courts" are properly called "Circuit Courts". Under the distribution of powers clause attorneys, who are sworn officers of the judicial department of government cannot also hold office as legislators (house or senate) or executives (Governor). The legal procedures necessary for civil and criminal court actions will have to be reviewed and brought into compliance with the "new" constitution. Determinations will have to be made as to reviews of prior cases for defects that could substantially alter the outcome of those cases based upon constitutional errors that may have to be corrected. Washingtonians who would like to participate in helping our elected officials work through this dilemma should call the Governor, Attorney General, and local legislative representatives and offer to serve on the committees and workshops which will be necessary to accomplish this monumental task. According to State Archivist David Hastings, 360-753-1801, there was a constitution for Washington Territory dated November 5th, 1878. Then there was a new Constitution dated 1889 for when Washington became a state (and it became permissable for the lawyers to take over all three branches of government. My comments.)
